Understand the Complete EB-5 Visa Process

The EB-5 Immigrant Investor Program offers eligible foreign investors a pathway to U.S. permanent residency through qualified investments that create American jobs. Whether you are applying from outside the United States or are already living in the U.S., understanding each stage of the process can help you prepare for a successful EB-5 journey.

Minimum Investment

Invest in a USCIS-qualified commercial enterprise. Current investment requirements depend on project eligibility, including Targeted Employment Areas (TEAs).

USCIS Petition

File Form I-526E with supporting documentation demonstrating lawful source of funds and investment eligibility.

Green Card

Receive a Conditional Green Card, later followed by permanent residence after filing Form I-829.

Outside United States

EB-5 Process for Overseas Investors

Applicants living outside the United States follow a structured immigration process beginning with documenting the lawful source of funds and ending with obtaining an unconditional Green Card.

1. Source of Funds

Prepare lawful source of funds documents with an experienced immigration attorney.

2. Choose Project

Review EB-5 Regional Center documents, complete due diligence, and make your investment.

3. File Form I-526E

Submit your immigrant petition to USCIS and wait for petition adjudication.

4. Consular Interview

Attend your U.S. Embassy or Consulate interview with your family members.

5. Conditional Green Card

Enter the United States and activate your lawful permanent resident status.

6. Capital Repayment

Receive investment repayment according to project offering terms and USCIS regulations.

7. File Form I-829

Remove Green Card conditions after meeting EB-5 program requirements.

8. Permanent Green Card

Receive your unconditional lawful permanent resident card.

Applicants Inside USA

EB-5 Process for U.S.-Based Investors

Foreign nationals already living in the United States may qualify for concurrent filing, allowing adjustment of status while their EB-5 petition is being processed.

Document Source of Funds

Work with your attorney to prepare lawful financial documentation.

Select EB-5 Project

Review project documents and complete the investment process.

Concurrent Filing

Submit Forms I-526E, I-485 and I-765 together when eligible.

Work Authorization

Receive Employment Authorization while your EB-5 petition is pending.

Conditional Green Card

Become a lawful permanent resident after USCIS approval.

Capital Return

Receive investment repayment according to project terms.

Form I-829

Submit petition to remove Green Card conditions.

Permanent Residence

Receive your unconditional Green Card and continue your journey toward U.S. citizenship.
